These terms of service constitute an agreement between you (hereinafter the “user”) and the applications, websites, documentation, and supplementary materials offered by MCVSoftware (hereinafter the “services”). Accessing and using any materials or files provided by the services constitutes full and unconditional acceptance of this agreement. If you do not agree with any or all of the following clauses, please refrain from using the services, revoke access to your credentials for the services, and delete any files, documentation, or supplementary material provided by the services for proper functioning.

1. Acceso a los Servicios

As part of our development, MCVSoftware produces software that is occasionally made available to the general public under open-source licenses. Access to services published under any form of open-source license is free of charge for any user. However, any costs related to the user’s ability to use the services, whether hardware, software, or internet access costs, are solely the user’s responsibility. The user is responsible for the proper functioning of their computer equipment and internet access.

Depending on the software, website, or platform, it may be necessary for the user to have a profile on a third-party site to fully utilize certain services offered by MCVSoftware. If the user does not have a registered profile on the third-party site, the functionality of the distributed software cannot be fully utilized.

MCVSoftware takes all reasonable measures to ensure quality service access but has no legal obligation to do so.

Additionally, MCVSoftware is not responsible for the incorrect or deficient operation of a network or server, whether owned by MCVSoftware or third parties, that may limit or prevent the use of the services as intended. MCVSoftware may limit total or partial access to the services or part thereof if it can ensure their restoration in the shortest possible time, without obligating MCVSoftware to provide any form of compensation.

1.2. Servicios Propietarios

In cases where, due to a specific initiative or project, MCVSoftware distributes software, documentation, or supplementary materials; or allows the use, free or paid, of cloud software platforms, you agree that all provided material will be for the exclusive, personal, and non-transferable use of the user. Reproduction, modification, study, and distribution, with or without profit, for any reason, are expressly prohibited without written authorization from MCVSoftware. By using any product or material distributed by MCVSoftware, unless otherwise stated, the user accepts and understands that the license granted to use the services constitutes unconditional acceptance of this clause. MCVSoftware reserves the right to interrupt the services or part thereof if, at any time, the user fails to comply with all of these terms, without implying that MCVSoftware will indemnify the user in any way.

2. Propiedad Intelectual

Unless otherwise indicated, the materials and software products offered through this website are the property of MCVSoftware. In some cases, we make the source code of software projects published under open-source licenses available to the general public to encourage development, study, and modification of such solutions.

3. Limitación de Responsabilidad

The use of information and content available through any of the applications and platforms related to MCVSoftware does not incur liability for MCVSoftware or any of its affiliates or providers. Only the user is responsible for the responsible and prudent use of the information provided by the services. Additionally, the use of the services is subject to the terms of service of Google, X, Amazon Digital Services LLC, Twishort, OCR.space, and VK in the corresponding services.

Furthermore, the user agrees to indemnify MCVSoftware for any damage that may result, directly or indirectly, from the use of the services.

In no case, to the extent permitted by law, does MCVSoftware assume responsibility for damage and/or harm, direct or indirect, material or immaterial, of any nature, arising from the unavailability of the Services or their Use. The term “Use” should be understood in its broadest sense, i.e., any use of Windows applications, web platforms, mobile applications, integration with other services, or Skills for Alexa, of any nature, legal or not.

4. Fuerza Mayor

MCVSoftware is not responsible in the event of force majeure or any incident beyond its control.

5. Modificaciones a Este Acuerdo

MCVSoftware reserves the right to modify the terms and conditions of this agreement at any time without notifying the user. Therefore, it is advisable for the user to consult the latest version of the Terms and Conditions of Use available at https://MCVSoftware.com/terms_of_service.

6. Duración y Disolución

El acuerdo tiene una duración indefinida, comenzando con el uso de los servicios por parte del usuario. El usuario puede terminar este acuerdo en cualquier momento dejando de usar las aplicaciones, plataformas web, aplicaciones móviles y documentación proporcionadas por los servicios y desactivando las Skills de Alexa, según sea necesario.
